The Internet and the Lost Law of Transit

"Despite [the internet's] importance, no doctrine of transit constrains states’ power to block or disrupt internet traffic that merely passes through their territory," writes Faculty Associate Vivek Krishnamurthy in a recent piece for The Yale Law Journal. Krishnamurthy argues in favor of extending transit-law protections to the internet, particularly given that the latter has risen to crucial infrastructure status.
