Woodrow Hartzog and Neil Richards argue that Clearview AI, a facial recognition software company, is wrongfully trying to use the First Amendment to ensure a freedom to surveil at will.

“The core of the First Amendment’s commitment to free speech is protecting individual speakers like protestors and journalists…not giving constitutional protection to dangerous business models that inhibit expression,” they write.
