Data enclosure by digital platforms

Empirical evidence

Maayan Perel, Ohad Somech, and Faculty Associate Niva Elkin-Koren analyze 279 platforms' Terms of Use to study how platforms use contractual terms to enclose publicly available data. Their paper, published in Big Data & Society, finds that privacy regulation has facilitated data enclosures, whereby third-party access is limited but a platform's own ability to use and share user data with partners is expanded.
