The US supreme court’s TikTok ruling is a scandal

The decision means TikTok now operates under the threat that it could be forced offline with a stroke of Trump’s pen

Faculty Associate Evelyn Douek and Jameel Jaffer argue that executive control over TikTok threatens both First Amendment rights and national security. Drawing comparison to the Red Scare, they maintain that "[c]ourts are supposed to have learned that it is their job to protect the democratic process by being skeptical of purported national security justifications for suppressing speech."
