Data as Likeness

Zahra Takhshid argues that personal data should be protected by the privacy tort of appropriation, thereby providing a way to give plaintiffs recourse in AI data collection suits. "It is now time for the common law to recognize data as likeness, that our personal data are our digital personas, and that collecting our data without our consent and using data for the collector’s benefit is a form of tortious invasion of privacy."
