New Study on European DRM Legislation

A new study by the Berkman Center’s Digital Media Project is the first of its kind to provide an overview of the current state of implementation of the European Copyright Directive (EUCD). The EUCD harmonizes divergent European copyright regimes and transposes the WIPO-treaties. In the report, Berkman Fellow Urs Gasser and researcher Michael Girsberger (Univ. of Lucerne) review the ways in which EU member states have applied the EUCD’s provisions regarding the protection of technological measures. The authors take a closer look at the relevant definitions, exemptions, and sanctions. In addition, the project website provides an interactive chart with a resource page containing international and national legislation on technological protection measures with focus on the relevant laws of EU member states for further research.
