Sun seems to think that they can shrinkwrap-license away first sale.
An excerpt:
Solaris New User Licenses for Used Systems Purchased from Third Parties
Unless specifically authorized by Sun, the Solaris license does not
transfer to a subsequent end user when a Sun system or system board is
resold. If a customer buys a used (pre-owned) Sun system from a third
party (i.e. not from Sun), the customer is responsible for making sure
that the used system has a valid Solaris license and the correct Solaris
software.
