As with Dred Scott? Too bad that the initiative was lost. Had his case been
appealed to the USSC, then either they would have declined to hear the appeal
or not. If they did they they would affirm it or not. IF not we win. If they
do, then it defines the boundary that must be redefined though
social/political/programming action. Rather than bringing the pot to a boil,
the pot has been left merely simmering.
