The EFF appeal to the Second Circuit Court of Appeals challenges the 
injunction issued by Judge Lewis Kaplan as an unconstitutional restriction 
of speech and on the press -- because it denies fair use of 
"technologically protected" media and because it prohibits publication of 
and linking to computer code on the ground that others might misuse that 
speech.
