Defendant, Kourosh Kenneth Hamidi, applies ex parte for an order to continue the hearing on the motion for summary judgment from the present date, January 11, 1997, to such other date as the Court deems appropriate, not earlier than June 1, 1999.

This application is made on the grounds that: (1) Code of Civil Procedure section 437c(h) requires the court to order a continuance of the motion for summary judgment when it appears from affidavits submitted that facts essential to justify opposition may exist but cannot, for reasons stated, then be presented; (2) Defendant Kourosh Kenneth Hamidi has acted with due diligence, but has not completed discovery necessary to present his opposition to the summary judgment motion, as set forth in the accompanying declaration of Kourosh Kenneth Hamidi.

Notice of this ex parte application, as required by Rule 379 of the California Rules of Court, and as required under rules 2.04 and 3.14 of the Sacramento Superior Court local rules, has been provided to Plaintiff.

This application is based on the accompanying memorandum of points and authorities and declaration of Kourosh Kenneth Hamidi, dated December 17, 1998, the pleadings and papers on file in this action; such matters of which this court may take judicial notice; and any additional argument and evidence as may be presented at the ex parte hearing.
