There seems to be an exception for shows that have
already been broadcast on conventional radio.  One of
my favorite podcasts is a college radio show...

...and plays a lot of stuff that isn't "pod safe".

I wonder if you could legalize a music podcast by
finding a slot at a radio station, maybe off hours
at a small station.
