Thoughts about the list:

13.  hiring human "trackers" or anthropologists to follow people in stores 
and see what they do...

This has been happening for a long time.. longer than the internet, and given 
that the shoppers are not identified, I actually don't have a problem with it.

12.  cell phone tracking "in house"

This has been happening for 4 years.. and I actually (with great objection) 
worked with the company that built the first one of these for Hard Rock Cafe 
casino in Los Vegas.. it's been going on for a long time and it's very 
uncool.. and more than the article recognizes happens:

The IMEI number is then matched to a database to try to get the user's cell 
number and then offers are "texted" outside the cell service.. but from the 
local tracking cells to the cell user.

High creepy factor and no notice or consent.. or maybe something like a 
small, 10" x 5" plastic sign at an emergency door way (the HRC casino does 
that in LV).

The rest of the items are just rifs on 12.. mostly.. tracking you in various 
ways but mostly without identity (except loyalty cards).

Mostly I don't mind this tracking, except the collection of the phone's data 
due to wifi use or non-use but offer of use, or the IMEI number .. they store 
the data and track repeat visits, try to match you with other online data or 
loyalty card info..

It's very very uncool.
