Under the DMCA "You have infringed my copyright" has been converted to 
"Something you did may someday be used to possibly do something I may not like 
or want somebody to do sometime in the future...SO I'm suing you and trying to 
send you to jail" 

BTW - I noticed in the 321Studios case they want a jury trial.....probably 
wise..
