What about this:
Let's say that the subtitles _are_ a derivitive work, and let's say I gave
them away for free.
a.) The consumer already has to have the video for the patch to work.
b.) They have a legal copy then.
c.) They have rights to the original work.

To say the translations are a derivitave work, you have to say that they
are basically the same thing (same expression of an idea, right?).  Which
would basically mean that the consumers already own it if they can use the
patch ;)
