In Lessig's article about Free Speech, he has mentioned that NY Times could first publish pentagon papers anonymously in USENET news group and then it will eliminate the need for constitutional protection. But I think these days hosts can be identified and then posting details can also be identified in terms of IPs, if ISPs closely see their log pattern even the end user is identifiable. In this case, can a court or the supreme court sue the web-host of the USENET?
