Anthony Ciolli, the founder and former webmaster of XOXO, had been invited and was planning to attend, but was disinvited at the 11th hour by the Dean of Students Office.  The official reason given was that that the DOS was concerned that the panel would be limited only to discussion of XOXO if Ciolli were to attend, and that the panel was intended to cover a broader range of issues.  However, particularly due to Fertick's presence, XOXO was the the main topic of discussion, and the quality of the discussion therefore suffered somewhat because the site was not properly represented. Professor Nesson took Ciolli's point of view, and although he did a good job of arguing the legal points, he was unfamiliar with the site's history and the details of the particular events in question.
