Let me outline some results of the open source provision:

1. People will circumvent it, they will be fined -- heavily.

2. It will not prove secure, therefore all copy protection will
be done in the hardware layer.

3. Industry will be able to hawk new hardware which uses this
new tech. therefore causing more hardware sales.

I think the whole plot is to get it done with hardware, however
they have to at least appear "fair."
